We are enclosing for <br />your information a copy of the deed by which Raton West took title <br />with attached legal description as well as a map of the property. <br />Raton West has three principal areas of concern at this time <br />which it believes should be brought to the attention of your <br />office. Raton West further requests that it be placed on the <br />mailing list, in care of myself, for all notices concerning actions <br />requested or to be taken by your office in regard to the Golden <br />Eagle Mine. <br />Raton West's first concern is the very important procedural <br />omission that Raton West was not directly informed of Basin <br />Resources plans to extract coal from under Raton West's property <br />until June 18, 1992. The property was purchased from Trinidad <br />National Bank by Mr. Baldwin on December 31, 1991, and then <br />conveyed to Raton West approximately one month later. It is our <br />understanding that Trinidad National Bank, the previous owner of <br />the surface, was also never informed of the plans of Basin <br />Resources to undermine the property. The failure of Basin <br />Resources to keep the surface owners advised of its mining plans <br />has resulted in serious problems for my client's intended use of <br />the property. The entire permit proceeding should be reopened to <br />allow my client full ability to comment and respond to all aspects <br />of Basin Resources' mining plan which could impact the Raton West <br />property. <br />NWN a R.n.ue ,y.r <br />
