_ . ~ M III IIIIIIIIIIIIIIII ~ <br />~r ~~~ <br />June 24, 1992 <br />Mr. Harry Pose <br />Mined Land Reclamation Division <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Re: Menzer Quarry <br />Dear Harry: <br />On your last visit to the Menzer Quarry you noticed some in- <br />consistencies of the permit boundaries on maps and stated a <br />need to clarify this matter. Being new owners of this operation, <br />our staff was unaware of this situation. <br />We researched the files given to us in the sale from Cooley <br />Gravel and found several maps which did indeed contain boundar~r <br />inconsistencies. The earliest boundary map we found is 1974 <br />which was used to obtain the E1 Paso zoning permit. This map <br />showed a 40 acre square piece of mining and a 16 acre piece on <br />the east side for processing and storage. Therefore, the tota:_ <br />permit area with the County is 56 acres. <br />At that time, the MLRD Regulations required the County permit <br />be obtained prior to the MLRD permit. We found no other maps <br />of the permit boundary between 1974 and 1977 so we can state <br />this 56 acres was also used for the MLRD permit in 1977. In <br />our files we found other maps since 1977 with boundaries which <br />show changes but we could find no legal or logical reasons for <br />these changes. <br />This month we hired a licensed land surveyor to go around the <br />56 acre perimeter on the property. Based upon this work all <br />the disturbed area in our operation is within this boundary. <br />With this letter you will find a revised annual report map <br />showing the correct boundary.
