<br />Summarv <br />The Review Process <br /> <br />Twentymite Coal Company submitted an application for a permit revision (PR-04) on April 2, 1997. The <br />application proposed to extend mining in the Eastern Mining District to include longwall panels 6R <br />through 2R,new associated gateroads in the Eastern Mining District, and new <br />development of the Northeast submains. The application also proposed to extend mining into the <br />Northern Mining District, which would include the Northwest mains, gateroads 11R through 18R and <br />including the western half of 19R, and mining of longwall panels 12R through 17R. <br />The Division found the application complete on April 12, 1997. The Division sent an a letter to the <br />operator identifying items that were inadequate or needed additional clarification on August 18, 1997. <br />The operator responded to the August 18, 1997 letter with a submittal on February 4, 1998. The Division <br />sent another letter identifying several unresolved concerns on February 27, 1998. Twentymite Coal <br />Company submitted responses on March 9, 1998. Additional questions were sent to Twentymite Coal <br />Company by the Division on March 13, 1998. Responses to the March 13, 1998 letter were received by <br />the Division on March 25, 1998. <br />The Division received comments from the Colorado Historical Society on Apri125, 1997. The Society <br />did not express concern or require additional cultural resource work unless "previously unidentified <br />archaeological resources are discovered in the course of the project..." <br />The Division received comments from the U.S. Fish and Wildlife Service on May 16, 1997 identifying <br />water depletion as the only stated concern regarding this revision. Twentymite Coal Company has <br />consulted with and gained approval for additional water depletion due to an increase in annual production <br />via Technical Revision No. 28. Information received from Twentymite Coal Company on February 4, <br />1998 projected water depletion in the Northern Mining District due to recharge of the alluvium resulting <br />from subsidence of the Fish Creek AVF. The proposed mining activities in the Northern Mining Disvict <br />were subsequently excised from PR-04. U.S. Fish and Wildlife Service concerns have been addressed for <br />the Eastern Mining District (Panels 6R-2R) and NE submains pertinent to PR-04. <br />The Division continued to have concerns with regard to the undermining of the Fish Creek Alluvial Valley <br />Floor, predictions, mitigation, and potential water depletions. Twentymite Coal Company consequently <br />removed all reference to mining in the Northern Mining District from this permit revision application <br />(PR04), on April 17, 1998. The Division is proposing approval of extended mining in the remainder of <br />the Eastern Mining District and development of the Northeast submains. <br />
