Hallenbeck <br />Delta County Board of Commissioners <br />5th and Palmer <br />Delta, Colorado 81416 <br />RE: Hawk's Nest Kline, File C-81-016 <br />Dear p1r. Hallenbeck: <br />I have received your letter dated September 27, 1988 concerning waste disposal <br />activities on property owned by P1r. Warren R. Cockroft. The agreement struck <br />between Mr. Cockroft and Western Slope Carbon, Inc. in 1981 was incorporated <br />into the mining permit which was issued in 1983. Therefore Western Slope <br />Carbon, Inc. is responsible for placing waste in the disposal site in a <br />controlled manner and reclaiming the site in accordance with the approved plan <br />and permit. Currently Western Slope Carbon, Inc. is not planning to dispose <br />of any additional waste material. However the reclamation liability remains <br />outstanding and the Division expects this liability to be met. In addition we <br />are holding a reclamation bond in an amount adequate to ensure that the <br />reclamation work gets done. <br />I understand, based on your letter, that Delta County is not interested in <br />Western Slope Carbon, Inc. disposing of any additional waste at the site. I <br />am assuming, however, that you are interested in seeing the site properly <br />reclaimed in accordance with the approved plan.
