CONCLUSIONS OF LAW <br />The Board finds the appropriate amount of bond for the Grassy Gap No. 1 Coal <br />Mine (C-039-81), which, in accordance with Rule 3.02.2, will be sufficient to <br />assure the completion of the reclamation plan if the work had to be performed <br />by the Board, through independent contractors, in the event of forfeiture, is <br />$446,680.00. <br />This total includes: <br />Partial backfill of haul/access road $ 8,360.00 <br />Shop removal 6,150.00 <br />Pit 4 revegetation ($618 per acre) 64,272.00 <br />Pit 6 reclamation (backfilling/grading and revegetation) 12,391.00 <br />Reclamation of ponds (pits 2 and 3) 13,000.00 <br />Backfill pit 4 232,500.00 <br />Revegetation of pits 1, 2, 3 and 5 ($200 per acre) 18,800.00 <br />Haul road stability analysis 50,000.00 <br />10% administration cost 40,607.00 <br />TOTAL 5446,680.00 <br />BOARD ORDER <br />Upon formal motion and by majority vote: <br />1) The Board endorses the attached settlement agreement <br />2) The Bond for the Grassy Gap No. 1 Coal Mine (C-039-81) is set at <br />$446,680.OU. <br />3) These Findings of Fact, Conclusions of Law and Board Order and the <br />attached Joint Settlement Agreement are a binding part of the <br />Grassy Gap No. 1 Coal Mine Permit (Number C-039-81). <br />~~ / ~~ <br />1 /,~ . , , n / ~ , /SY.(.l <br />Davis C.
