Johnston <br />DIVISION OF MINERALS AND GEOLOGY <br />Office of Mined Land Reclamation <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: West Elk Mine, Permit No. C-80-007, Temporary Excess Subsoil Stockpile <br />Dear Christine: <br />~~ <br />Mountain Coal Company (MCC) is in the process of cleaning and excavating the northern portion <br />of sediment pond MB-1 in preparation for lining with a geotextile clay liner, as approved per <br />Minor Revision No. 109. The plans require that approximately three feet of soil be excavated <br />from the pond floor. MCC has no projects currently underway to utilize this soil, so it is being <br />stockpiled to the west of the pond where the subsoil for the dike was stockpiled, per Minor <br />Revision No. 105. The area was previously disturbed by the subsoil stockpile and straw bales <br />have been installed to control sediment from the area. If no projects develop by the end of the <br />summer that will utilize the stockpiled soils and /or the soils from the dike, this soil will be hauled <br />to and stored in the Sylvester Gulch subsoil stockpile. <br />Please contact me should you have questions. <br />Sincerely, <br />~~~ ~~~~~ <br />Kathleen G.
