Findings of the <br />Colorado Mined Land Reclamation Division <br />for <br />Wucla Strip Mine <br />Explanation of Findings <br />Pursuant to Rule 2.07.6(2) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, and the approved state program, the Mined <br />Land Reclamation Division or the Board must make specific written findings <br />prior to issuance of a permit, permit renewal or permit revision. These <br />findings are based on information made available to the Division that <br />demonstrates that the applicant will be able to operate in compliance with the <br />Colorado Surface Coal Mining Reclamation Act and the Regulations promulgated <br />pursuant to the Act. <br />The findings in the following sections required by Rule 2.07.6(2) are listed <br />in accordance with that Rule. The findings and specific approvals required <br />pursuant to Rule 2.07.6(2)(m) are listed in accordance with Rule 4 and are <br />organized under subject or discipline sub-titles. <br />This findings document has been updated for this permit revision. The <br />following findings have been reevaluated and updated if necessary to reflect <br />changes which will occur as a result of this permit revision. <br />SECTION A <br />Findings Required by Rule 2.07.6(2). <br />1. The permit revision application is accurate and complete except for the <br />following maps: <br />Nucla <br />Exhibits 12-1; 13-1; 13-4; 13-6; 20-1; 20-2; 22-1. These maps require <br />incidental permit boundary changes to be accurate. Otherwise, the <br />information depicted on them is accurate. Therefore, the following <br />stipulation will be incorporated into the approval package for permit <br />revision number two: <br />Stipulation Number 4: <br />EXHIBITS 12-1; 13-1; 13-4; 13-6; 20-1; 20-2; 22-1 WILL BE MODIFIED TO <br />REFLECT THE APPROVED PERMIT BOUNDARIES AS DEPICTED ON ALL OTHER PERTINENT <br />AND APPROVED MAPS OF THE NUCLA AREA. THE MAPS MUST BE SUBMITTED TO <br />DIVISION OFFICES NO LATER THAN MAY 1, 1989. <br />Nucla East <br />Exhibits 6-7; 7-1; 7-2; 7-3; 7-4; 7-6; 10-2; Attachment 11-2, Map 1; <br />11-3; 13-2; Attachment 16-1, Figures 1, 2, and 3; 17-1; 17-2. These maps <br />require incidental permit boundary changes in order to be accurate. <br />Otherwise, the information depicted on them is accurate.
