The Union <br />Pacific Railroad, owner of the property, has repeatedly voiced its interest in <br />retaining the site as an industrial loadout facility. It is inappropriate to <br />apply rigorous vegetation standards to a site which is to be used as an industrial <br />site. <br />Also, the Northgate loadout had been significantly disturbed before Walden <br />Coal Company obtained any interest in it. Due to the previous disturbance and <br />the fact that the site is to be retained as an industrial loadout facility, site <br />specific baseline vegetation studies were not conducted. Therefore, there is no <br />good data on which to base post-disturbance vegetation standards. <br />I would like to request your reconsideration of this matter in light of the <br />above discussion.
