The Division finds that the activities proposed by the applicant would <br />not affect the continued existence of endangered or threatened species or <br />result in the destruction or adverse modification of their critical <br />habitats (2.07.6(2>(n>>. <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Branch. As of February 25, 1993, the operator is current in the payment <br />of reclamation fees required by 30 CFR Chapter VII, subchapter R <br />(2.07.6(2)(0)). <br />SECTION 6 <br />The following findings and specific approvals are required by Rule 4: <br />I <br />Roads - Rule 4.03 <br />A. Haul Roads <br />1. The Division has approved the <br />haul road depicted on Map No. <br />approved post-mining land use, <br />was submitted by the landowner <br />8. Access Roads <br />retention of a portion of the <br />8 since it is compatible with the <br />and a request for its retention <br />(4.03.1(1)(f)(i)). <br />The landowner has requested the retention of the access road <br />depicted on Map No. 8. Its retention is compatible with the <br />approved post-mining land use of pastureland. Therefore the <br />Division has approved retention of the access road <br />(4.03.2(1)(f)). <br />II <br />Hydrologic Balance - Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />All disturbed area drainage passes through sedimentation ponds <br />or traps. Discharges from these ponds are monitored to verify <br />compliance with water quality standards and effluent <br />limitations (4.05.2(2>). <br />B. Sedimentation Ponds <br />All runoffs from disturbed areas are currently routed through <br />four sediment control ponds and one sediment trap. Sediment <br />pond 002 is located on the western edge of the East Pit Area. <br />Sediment pond 003 is located on the northeastern edge of the <br />permit boundary. Two sediment ponds, 004 and 005, serve as <br />sediment control structures in the Barren Ridge and Federal <br />Lease Areas. The sediment trap lies below sediment pond 002. <br />All of the above-mentioned sediment structures were designed <br />and constructed under the supervision of a registered <br />professional engineer.
