Bozarth <br />Harrison Western Corporation <br />4860 Robb St., Suite 101 <br />Wheat Ridge, CO 80033 <br />Dear Mr. Bozarth: <br /> <br />We were sorry that Harrison Western reversed its reclamation commitment that <br />Mr. Baillie had stated in our office on Feb. 24, 1992, for the West pit and <br />the stockpile 112. We believe that he said that he understood that the <br />stockpile lit was the material taken from the pit and that you would reclaim <br />the stockpile. <br />Since the Mined Land Reclamation Board meeting on Feb. 26th, we have learned <br />that there are additional reclamation problems regarding the West pit. That <br />pit was mined across an alluvial valley floor with an ephemeral stream <br />draining a large watershed. There is no diversion of the surface water to <br />prevent it entering the disturbed area, and the volume of water from a 10 <br />year, 24 hour precipitation event is many times larger than the containment <br />volume of the sediment pond even if cleaned. Further, because of the large <br />volume of water, it is probable that the pond should be under the regulations <br />of the Mine Safety and Health Administration, especially to protect the safety <br />of the Energy Fuels underground mine from inundati.en. <br />Sincerely, <br />/l' C <br />(N ~ ~ <br />W.D.
