Bozarth
Harrison Western Corporation
4860 Robb St., Suite 101
Wheat Ridge, CO 80033
Dear Mr. Bozarth:

We were sorry that Harrison Western reversed its reclamation commitment that
Mr. Baillie had stated in our office on Feb. 24, 1992, for the West pit and
the stockpile 112. We believe that he said that he understood that the
stockpile lit was the material taken from the pit and that you would reclaim
the stockpile.
Since the Mined Land Reclamation Board meeting on Feb. 26th, we have learned
that there are additional reclamation problems regarding the West pit. That
pit was mined across an alluvial valley floor with an ephemeral stream
draining a large watershed. There is no diversion of the surface water to
prevent it entering the disturbed area, and the volume of water from a 10
year, 24 hour precipitation event is many times larger than the containment
volume of the sediment pond even if cleaned. Further, because of the large
volume of water, it is probable that the pond should be under the regulations
of the Mine Safety and Health Administration, especially to protect the safety
of the Energy Fuels underground mine from inundati.en.
Sincerely,
/l' C
(N ~ ~
W.D.
