Cairns <br />Land Use Administrator <br />County of Ouray <br />Bin C <br />Ouray, CO 81427 <br />.... 1 1977 <br />Re: Mined Land Reclamation Board Permits <br />Gear Ralph, <br />IN REPLY REFER TO <br />3620 <br />(161) <br />It is our opinion that the only permit that a county needs to mine <br />gravel on public lands is a valid "free use permit" issued by the ap- <br />propriate Bureau of Land Management Office. These permits are subject <br />to special stipulations designed to insure extraction of the resource <br />within proper environmental constraints and provide for adequate re- <br />storation upon completion of operations. A performance bond may be <br />required at the discretion of the District Manager. <br />It appears that State and Federal policies and objectives are similiar. <br />However, in order to prevent duplication of effort on the applicants <br />part and prevent jurisdictional conflicts between the agencies, we <br />contend that only the Federal government will have jurisdiction over <br />federally owned or controlled minerals. <br />Enclosed is a copy of a letter dated October 22, 1976, from the Colorado <br />State Director, Bureau of Land Management to Mr. Gilbert F. Rindahl, <br />P.E. Director, Mined Land Reclamation, Colorado Dept. of Natural Re- <br />sources.
