On February 19, 1993, this Court entered the Order <br />Dated February 19, 1993 Estimating the Claims of UMWA <br />Combined Benefit Fund and of 1992 UMWA Benefit Plan Pursuant <br />to Motions Dated January 26, 1993 ("Estimation Order"). <br />2. Prior to September 12, 1995, the Estimation Order <br />was the subject of appeals by the Combined Fund and the 1992 <br />Plan to the United States District Court for the District ~~f <br />Utah ("District Court"). Pursuant to a settlement agreement <br />dated May 5, 1995 ("Settlement Agreement"), which was <br />approved by this Court's June 13, 1995 Order Approving Motion <br />Dated May 8, 1995 for Approval of Settlement Agreement by 'the <br />Reorganized Debtors, UMWA Combined Benefit Fund, and 1992 <br />UMWA Benefit Plan and Trust ("Settlement Order"), the parties <br />to the appeal requested the District Court to dismiss the <br />appeal of the Estimation Order and remand the matter to this <br />Court for vacatur. <br />3. On September 12, 1995, an order from the District: <br />Court was entered dismissing the appeals of the Estimation <br />Order ar~d remanding tha matter to this Court with <br />instructions to vacate and withdraw the Estimation Order <br />"subject to the entry of an order of the Bankruptcy Court, to <br />the extent that the Bankruptcy Court deems such an order to <br />be appropriate, that the withdrawal and vacatur will not <br />disturb findings made by the Bankruptcy Court required for <br />confirmation of the Debtors' and Railroad Trustee's First <br />- 2 - <br />
