<br />Refractories and Minerals Corporation ("National Refractorie:~"), <br />will be heard by the Honorable Judith A. Boulden, United States <br />Bankruptcy Judge, on wednesdav. September 29. 1993, at the hour <br />of 3:00 p.m._, or as soon thereafter as counsel may be heard, in <br />Judge Boulden's Courtroom located on the third floor of the <br />Federal Courthouse Building located at 350 South Main Street., <br />Salt Lake City, Utah. The Motion requests approval of a <br />settlement of the above-captioned adversary proceeding between <br />the parties. CF&I brought this action against National <br />Refractories alleging that certain transfers made to it <br />constitute avoidable preferences under 11 U.S.C. § 547(b). The <br />parties have agreed to settle the matter with National <br />Refractories making a payment of $6,000.00 and being permitted to <br />file an unsecured claim in the same amount or an amended <br />unsecured claim including such an amount. Copies of the Motion <br />and the related Settlement Agreement may be obtained by request <br />from the undersigned counsel for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 523(b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and served <br />upon the undersigned counsel on or before Tuesday, September 21, <br />1993. Absent timely filing and service of objections, the <br />hearing may be stricken and the relief sought in the Motion may <br />be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and served <br />2 <br />
