• • Page 6 of 7 <br />c. The applicant shall submit design data for each of the Moffat area sedi- <br />mentation pond inflow ditches. This information shall include evidence <br />that ditch slopes will provide positive drainage to the ponds with <br />acceptable velocities. The information should also demonstrate that <br />berms to be constructed will not significantly impound water. <br />3. a. Pittsburg and Midway, in conjunction with the regulatory authority, will <br />establish a revegetation standard for the reestablishment of woody plants <br />(woody plant density) no later than 30 days after permit approval. <br />b. Pittsburg and Midway, in conjunction with OSM and the Division, will <br />establish a revegetation standard for species diversity at the Edna <br />Mine no later than 30 days after permit approval. <br />c. Pittsburg and Midway, in conjunction with OSM and the Division, will determine <br />applicable revegetation success criteria for the area known as West Ridge <br />at the Edna Mine. These success criteria shall be determined no later <br />than 30 days after permit approval. <br />4. Prior to disturbance in the Moffat area, the applicant shall submit and <br />receive approval of a proposed plan concerning the deposition of excess <br />spoil outside of the mined area. Adequate analyses will be submitted to <br />determine compliance with Part 4.09 (SMRCA 816.71) of the Colorado Permanent <br />Regulatory Program, including, but not limited to, stability analyses, <br />construction details and hydrologic assessment. <br />5. Prior to mining in the Moffat area, the applicant shall demonstrate, based <br />upon on-the-ground performance, that the convex lower slopes do not cause <br />tilling and gullying or that tilling and gullying on these slopes can be <br />controlled. If the applicant's efforts to control tilling and gullying <br />in the areas reclaimed prove unsuccessful, the applicant would redesign <br />the postmining topography to eliminate the convexity from the lower portions <br />of the slope. <br />6. The applicant must provide to the regulatory authority, design and construction <br />criteria, drainage designs, surfacing substances, plans for maintenance and <br />plans for reclamation for all access roads and light duty roads within 120 <br />days of permit issuance. <br />7. Pittsburg and Midway is directed to prepare road cross-sections to portray <br />the existing proposed roadway system at the Edna Mine within 120 days of <br />permit issuance. For existing roadways, cross-sections should be prepared <br />for any section of a roadway whose cut or fill slopes exceed the maximum <br />regulatory slope limits. For proposed nonexisting roadways, cross-sections r <br />should be prepared on a center-line interval appropriate to depict the <br />character of those roadways. Specific worst-case cross-sections should be <br />prepared for each road segment which exceeds the regulatory slope limits . <br />Further, Pittsburg and Ididway is specifically directed to prepare and <br />submit cross-sections, on 100 foot center-line intervals, for the approximate <br />50 foot high embankment fill proposed to be located near station "MC 23" <br />and for the embankment fill road segment proposed to exist between stations <br />"E 1" and "E8". This cross-sectional data shall be approved by the division <br />prior to the construction of any of the proposed roadways at the Edna Mine. <br />
