• • Page 6 of 7 c. The applicant shall submit design data for each of the Moffat area sedi- mentation pond inflow ditches. This information shall include evidence that ditch slopes will provide positive drainage to the ponds with acceptable velocities. The information should also demonstrate that berms to be constructed will not significantly impound water. 3. a. Pittsburg and Midway, in conjunction with the regulatory authority, will establish a revegetation standard for the reestablishment of woody plants (woody plant density) no later than 30 days after permit approval. b. Pittsburg and Midway, in conjunction with OSM and the Division, will establish a revegetation standard for species diversity at the Edna Mine no later than 30 days after permit approval. c. Pittsburg and Midway, in conjunction with OSM and the Division, will determine applicable revegetation success criteria for the area known as West Ridge at the Edna Mine. These success criteria shall be determined no later than 30 days after permit approval. 4. Prior to disturbance in the Moffat area, the applicant shall submit and receive approval of a proposed plan concerning the deposition of excess spoil outside of the mined area. Adequate analyses will be submitted to determine compliance with Part 4.09 (SMRCA 816.71) of the Colorado Permanent Regulatory Program, including, but not limited to, stability analyses, construction details and hydrologic assessment. 5. Prior to mining in the Moffat area, the applicant shall demonstrate, based upon on-the-ground performance, that the convex lower slopes do not cause tilling and gullying or that tilling and gullying on these slopes can be controlled. If the applicant's efforts to control tilling and gullying in the areas reclaimed prove unsuccessful, the applicant would redesign the postmining topography to eliminate the convexity from the lower portions of the slope. 6. The applicant must provide to the regulatory authority, design and construction criteria, drainage designs, surfacing substances, plans for maintenance and plans for reclamation for all access roads and light duty roads within 120 days of permit issuance. 7. Pittsburg and Midway is directed to prepare road cross-sections to portray the existing proposed roadway system at the Edna Mine within 120 days of permit issuance. For existing roadways, cross-sections should be prepared for any section of a roadway whose cut or fill slopes exceed the maximum regulatory slope limits. For proposed nonexisting roadways, cross-sections r should be prepared on a center-line interval appropriate to depict the character of those roadways. Specific worst-case cross-sections should be prepared for each road segment which exceeds the regulatory slope limits . Further, Pittsburg and Ididway is specifically directed to prepare and submit cross-sections, on 100 foot center-line intervals, for the approximate 50 foot high embankment fill proposed to be located near station "MC 23" and for the embankment fill road segment proposed to exist between stations "E 1" and "E8". This cross-sectional data shall be approved by the division prior to the construction of any of the proposed roadways at the Edna Mine.
