IV. PROPOSED DECISION <br />Based on the observations above, the Division proposed to approve KCC's request for a <br />Phase I Bond Release for the Man Pit azea of the Man Mine. This proposed decision <br />will release the applicant from liability for backfilling, grading and drainage <br />controUreestablishment on the 96.5 acres included in the Marr Pit azea. <br />The Division holds a performance bond of $1,817,911.00 for the Man Mine. The <br />required performance bond amount is $700,270.00. The Division released $1,117,641.00 <br />on 26 June 2001 but has not, to date, received a rider to reduce the bond. As stated <br />above, this request does not include the release of any (additional) bond monies. This <br />decision will only release KCC from liability associated with backfilling, grading and <br />drainage controUreestablishment for the 96.5 acres of the Man Pit. <br />Any person with a valid legal interest who might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Boazd <br />in accordance with Rule 3.03.2(6). Public notice of this proposed decision will be <br />published two times in The Jackson County Star as soon as practically possible. <br />Requests for a public hearing must be submitted to the Division in writing within thirty <br />(30) days of the first publication in The Jackson County Star. If no hearing is requested <br />within thirty days, the Division's decision will become final. <br />Marr Mine SL-03 5 28 January, 2002 <br />
