Page 3
March 1, 2007
existing performance bond due to subsidence related structural damage is found under
"Subchapter K -Permanent Program Performance Standards"; "Part 817 -Permanent
Program Performance Standards -Underground Mining Activities". Finally, in his
"732" letter dated June 5, 1996, then Western Regional Coordinating Center Director,
Richard Seibel informed DRMS that they would have to potentially revise their program
in four distinct areas -Statute; Definitions; Permitting Requirements; and Performance
Standards. Surprise, surprise the discussion regarding 30 CFR 817.121 (c) (5) can be
found under the performance standard section!
Gentleman, I believe that more than 10 years of attempting to educate you as to
what your job entails and as much time in prodding you to actually perform that job is
enough. I, therefore, fully expect you to expedite your review of the DBMS "732"
response and if the response is affirmed, as written, I demand that you or the DRMS
immediately take the action necessary to ensure the timely compliance with the
performance standard found at 30 CRR 817.121 (c)(5).
Promptly copy me any correspondence relating to any of the above noted matters.
Very truly yours,
nn Tatum 0.
Cc: Mr. Dave Berry Facsimile (303) 832 8106
Division of Reclamation, Mining & Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203
United States Senator Ken Salazar
702 Hart Senate Office Building
Washington, D.D. 20510
Facsimile (202)228-503b
United States Senator Wayne Allard
521 Dirksen Senate Office Buildinfi
Washington, D.D. 20510
Facsimile (202) 224-6471
United States Congressman John T.
