We regret <br />the extended delay beyond the original response deadline, however, deficiencies <br />in the original plan with regard to MLA requirements required additional <br />submissions and consultation with the mine operator. This additional <br />information has met our needs and allowed a determination that the mine plan <br />fully complies with the requirements of the Mineral Leasing Act and 43 CFR 3480 <br />including MER requirements. We have included a copy of our technical analysis <br />for your information. <br />The Raya1:G iLeeaa=9~-~ea has reviewed the expanded permit area vhich <br />contains-~- _ ot`~i~ally owned coal but no public surface estate. The <br />lack of ae~. -t~eaased surface estate necessarily liaited their review <br />for only s-ler which their is eoae Federal management authority, <br />such ao- -.e`nd'angered epeeiee, cultural and paleontological <br />reaoareee.~ 1N aeseschli ea the surface o€ the Federal owned coal estate were <br />identified; is any case. the proposal results in no direct surface impact e, or <br />indirect iapacta through subsidence, vhich could affect these surface estate <br />resources. <br />Accordingly, this o€f ice reco®enda the revised R2 P2 contained within the <br />revision for approval without stipulation. <br />~~,an n <br />~""' ~" <br />
