The mine is owned by Western Slope <br />Carbon', Inc. and is located near Somerset, Colorado in Gunnison County and is <br />on federal lands as defined by PL 95-B7, Sec. 701(4). <br />In support of this. allegation, we note the statements contained <br />in the State inspection report of Sept. 4, 1981, pp. 1-2. A copy of this <br />report is attached to this letter. The report states: <br />Being an off-site refuse area, the disposal site was not <br />previously permitted by the. Division, but will have to be <br />', permitted under the permanent program. <br />In May, 1981, WSC indicated that their current <br />disposal area was being rapidly filled, and an inquiry <br />was made regarding information which would be required in <br />order to permit disposal of waste on private land. . <br />None of the requested information was submitted to the <br />Division, and no geotechnical or hydrologic studies have <br />been completed. <br />~~~ <br />Im Isnur.
