• i <br />"D" Contract No 02-z75-o <br />CONTRACT <br />THIS is an agreement between GROUNDWATER APPROPRIATORS OF THE SOUTH <br />PLATTE RIVER BASIN, iNC., a Colorado non-profit corporation, (hereinafter <br />called "GASP"), and the undersigned party (hereinafter called "the party <br />of the second part"). <br />RECITALS <br />1. GASP represents that it is a Colorado non-profit corporation and that its <br />primary purpose is the acquisition and development of augmentation water for <br />persons awning, controlling, or operating wells in the South Platte River <br />Valley, reducing the necessity for state regulation of their wells, thereby <br />protecting the economy which is dependent upon those wells and increasing the <br />beneficial use of the water available in the South Platte River Basin. <br />2. The party of the second part represents that he is a resident of the <br />State of Colorado, tfiat he owns, controls or operates the wells listed on the <br />attached well data sheet and that he desires a share of the augmentation <br />water and benefits of the program for protection of his listed wells. <br />AGREEMENT <br />1. The party of the second part requests that the welis described on the <br />well data sheet be re istered in the augmentation program and tenders as full <br />payment the sum of S ~42B•GC as the registration fee for 19 99 which has been <br />computed in the manner shown on the well data sheet. The party of the second <br />part agrees that GASP may accept or reject the registration on a well by well <br />basis. <br />2. The party of the second part hereby specifically acknowledges that <br />this contract is limited to the calendar year 79 99 and that GASP is under <br />no obligation to renew said contract or furnish any water or benefits for <br />any subsequent year. This contract shall automatically terminate <br />as to both parties and be of no further force or effect from and after <br />December 31, 19 99 . <br />3. if any of the wells described on the well data sheet is not accepted <br />for registration by GASP, because it cannot reasonably provide augmentation <br />water for such well or otherwise, the fee for such well will be refunded. No <br />fee will be refunded with respect to any we 11 accepted for registration by GASP. <br />4. With respect to each well registered in its augmentation plan, GASP <br />agrees to use its best efforts to develop, put into effect and have accepted <br />by the State Engineer a plan which will minimize the need for regulation <br />of the well by the State Engineer during the caiendar year 19~, and to <br />provide the owner of such well with a share of the augmentation water which <br />GASP develops, for use by such owner in the protection of his well from <br />regulation. Nothing in this agreement shail require GASP to initiate or <br />defend actions in connection with any augmentation plan or in connection with the <br />rights of any well owner, or to bear the cost of any proceedings. <br />5. GASP will use Its best efforts to allocate to each well which 1t accepts <br />for registration, an equitable share of any benefits to be derived from the <br />plan. However, it is understood that the benefits which are allocated to <br />each well will depend on a number of factors, including the number and location <br />of wells which are accepted for registration. <br />6. Neither this contract nor any benefits which may accrue to the party <br />of the second part hereunder may be assigned to any other party or any other <br />well, without the express written consent of GASP. <br /> <br />
