<br />19. Rule 2.04.3(1) (Statute 34-32-110(2)) <br />The permit is in compliance with this section. Plate 1, however, seems to be cut in <br />half. Could you provide an extra whole copy? Thank you. <br />20. Rule 2.04.3(2)(a) (Statute 34-32-111(1)(b)) <br />The permit is in compliance with this section. The text on page F-1 describes the pre- <br />mining land use as livestock and wildlife dryland grazing, according to the County <br />Planner. Maps found at Plates 1, 13 and 16 and Figures 5 and D-10 identify the pre- <br />mising site conditions, topography and drainage patterns, soils, vegetation, pre-existing <br />structures, and extent of surface disturbances, including the historic McCallum Mine. <br />A discussion of the McCallum Mine is provided on pages B-1 and B-2 in the <br />"Archaeology" section. <br />21. Rule 2.04.3(2)(b) (Statute 34-32-111(ll(b)) <br />A narrative providing that information described in Rule 2.04.3(2)(b)(ii) appears to be <br />absent from the permit. Please indicate where this information may be found, or <br />provide it as an update. <br />22. Rule 2.04.3(3) (Statute 34-32-111(1)(b) <br />A description of the McCallum Mine, with apre-mining aerial photograph showing the <br />extent of pre-permit mine disturbance, is included in the permit. As such, the permit is <br />in compliance with this Rule. <br />23. Rule 2.04.3(4) (Statute 34-32-111) <br />Descriptions of the pre-existing land uses and land use classification for the permit area <br />and adjacent area are included in the permit. The permit is in compliance with this <br />Rule. <br />24. Rule 2.04.4 (Statute 34-32-110(2)(a) <br />Appendix C provides a 1979 Cultural Resources Inventory Report prepared by <br />members of the Department of Anthropology of the University of Colorado (Boulder). <br />The conclhsion found in this report states, "The Bourg coal property and the two access <br />roads studied do not contain significant cultural resources." The permit is thus in <br />compliance with this Rule. <br />25. Rule 2.04.5 (Statute 34-32-110(2)(k)) <br />The information in the current permit text is adequate considering the mine is fully <br />reclaimed. <br />-5- <br />
