Rule 2.07.6(2)(d)(iv) (Statute 34-32-114(2)(e)Ql>)) <br />It is stated on page D-8 of the permit that the Northgate L.oadout lease included a <br />" 20 fr. side strip of land from the edge of Colorado State Highway 125 into the general <br />loading area." On Plate 19, "I-oadout Facility," this strip measures 20 feet wide by <br />348+ feet long, is labeled as a road and indicates that a cattle guard and culvert were <br />placed just west of Colorado Highway 125 in conjunction with this road. <br />Does this road still exist? If not, why not? If the road no longer exists, the permit text <br />and Plate 19 should be revised to reflect its removal. <br />44. Rule 2.09 (Statute 34-32-1121 <br />The permit is in compliance with this Rule. This operation did not request assistance <br />through the Small Operator Assistance Program. <br />45. Rule 3 (Statute 34-32-1131 <br />The permit is in compliance with this Rule. The Division currently holds Corporate <br />Surety Performance Bond No. 400 HE 7644 in the amount of $214,400.00, issued by <br />St. Paul/Seaboard Insurance Company to Flatiron Companies dba Walden Coal <br />Company. This amount reflects what is lefr after a 60 percent Phase I Bond Release <br />that was granted on December 4, 1989. <br />The legal descriptions of the mine site and loadout identified on the bond form <br />correspond to the permit boundaries in the mine permit. <br />46. Rules 4.01. 4.02 and 4.03 (Statute 34-32-120(2)(q~ <br />The permit text at page D-8 indicates that access to the Northgate Loadout by Walden <br />Coal haul trucks occurred from Jackson County Road 38. Plate 19 identifies anorth- <br />south section of road from Jackson County Road 38 to the loadout measuring between <br />450 and 550 feet long. Please describe whether this north-south section of road is a <br />light-use, access or haul road, whether it is a private road that was never designated as <br />any of these types of roads, or whether it is a part of Jackson County Road 38. <br />47. Rule 4.04 (Statute 34-32-103(261) <br />The permit is in compliance with this Rule. <br />48. Rule 4.05 (Statute 34-33-111(1)(m)) <br />The permit is in compliance with this Rule, with the exception of those issues <br />previously discussed in this review. <br />-10- <br />
