<br />(b) With regazd to the "domestic well" referenced in the January 29, 1988 letter, does <br />this well exist? Has it been reclaimed? <br />(c) With regard to the "domestic well," is it the same as the well referred to on <br />Plate 1 as the "water use" well? If not, please revise Plate 1 to identify the <br />location of the "domestic well" (Rule 2.04.7(4)(a)). <br />(d) Page I-31 of the permit appears to indicate that Walden Coal received a permit <br />from the Colorado Water Court to use the "water use well" for mine operations. <br />If the "water use well" still.exists and Mr. Bush wishes to use it, does Walden <br />Coal intend to submit to the Division a request for well transfer pursuant to <br />4.05.14? If so, it should be done as soon as possible. If not, please state why <br />not. <br />(e) It is appazent from the permit (page I-31) that the permit for the "water use well" <br />was issued by the Colorado Water Court for industrial use. If this is true, and <br />Mr. Bush wishes to use the well for domestic purposes, are there any domestic <br />ground water quality standazds the well must meet fnst (Rule 4.05.1(3))? If so, <br />Walden Coal will need to demonstrate, pursuant to Rules 4.05.13(1)(b)(ii) and <br />4.05.13(3)(b), that the quality of water in the "water use well" meets the <br />applicable groundwater standards for domestic use. <br />(f) As stated in the immediately preceding paragraph, it is apparent that the permit <br />issued to Walden Coal for the "water use well" was for industrial purposes. If <br />Mr. Bush wishes to use this well for domestic purposes, will there need to be any <br />revision to the well permit to reflect this change in use? <br />(g) With regard to the "septic system" referenced in Mrs. Peep's letter of January 29, <br />1988, was it ever installed? If so, please revise Plate 1 to identify its location <br />(Rule 2.05.3(2)(b)). <br />(h) If the septic system was installed, does it still exist or has it been reclaimed? <br />(i) If the septic system was installed and has not been reclaimed to date, please <br />provide a letter from Mr. Bush describing whether he wishes it to remain or to be <br />reclaimed (Rule 2.05.5(1)(b)). <br />(j) If the septic system currently exists uttreclaimed, do any approvals for its <br />existence need to be obtained from any local, state or federal government entities? <br />If so, have they been obtained? If they have, please provide copies of the <br />approval documents (Rule 2.03.10) from all applicable agencies. If approvals are <br />necessary, but have yet to be obtained, please state when they will be obtained. <br />(k) If the septic system still exists and Mr. Bush wishes it to remain, Walden Coal <br />needs to revise the Bourg Mine permit to reflect that Jackson County has found <br />that the septic system falls under the pre-mining land use classification category of <br />"unimproved dry grazing" (page F-1 of the permit) if that classification is still in <br />-8- <br />
