further request that a notice be mailed or phoned to me so that I
receive a minimum of 24 hours notice prior to any blasting. And
upon completion of each blast I request to be mailed a report
showing actual data recorded from the monitoring equipment and
manipulated data from Western Fuels records.
FENCING: When I purchased my property I bought a piece that is 300' x 600'.
Through a gentleman's agreement I am using a portion of Benson's
property and he is using a portion of mine with the understanding
that he or whoever he leases to will irrigate the portion of his
property that is currently fenced for my use. Ross Gubka, advised
me that Western Fuels would mark my corners and then fence
either my property line or additional property allowing me usage of
Benson property that is not being mined whichever would benefit
me. I would like to see this in writing signed by both Western Fuels
and Mr. Benson.
ANIMALS: I currently lease property near and surrounding my own to pasture
my horses. I also raise chickens for breeding and egg production.
I need sufficient written notice as to when construction of the new
road will commence as I lease property adjacent to the proposed
road or blasting for mining operations will occur in order to prevent
harm to my animals. I also need written confirmation that Western
Fuels will hold responsibility should any harm that comes to my
animals due to construction or mining operations.
PRAIRIE DOGS:
My property is used for grazing horses that I use for my personal
enjoyment. History shows that the land purchased or leased, as it
is dried up, turns into a prairie dog town. What is going to happen
as they move closer to my place? The dogs will move in. I can
control a few but I cannot control all that are heading my way.
Ross Gubka, advised that Western Fuels would buy us a case of
bullets. How are the operators going to feel as these bullets are
flying across their heads as I am controlling the prairie dogs? My
other option is to make my property a haven for the dogs.
WATER: I currently own 2 shares of water of Colorado Cooperative Water.
My understanding is that no matter what the Ditch Company agrees
to Western Fuels must provide me with my water. I would like to
have in writing their agreement to piping my water to the same
place I currently access it from the ditch and that no further
contamination will happen as a result of mining operations.
