MCM 84-29 APR 2 f; 1984 <br />Planning Department No. C2-84 <br />Granting a Conditional Use Permit forMINED ND RECLAMATION DIVISION <br />Granite Mining and Crushing Operations an601o. pt. of Natural Resources <br />Amethyst Mining to John Schmahl <br />WHEREAS, John Schmahl sought to have an amet yst mine <br />and a granite mine and crusher on the following describ d land <br />situated in the County of Mesa, State of Colorado, to w't: <br />(see attached) <br />and <br />WHEREAS, the hearing before the Board of <br />Commissioners was held February 21, 1984, <br />NOW THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF <br />THE COUNTY OF MESA FINDS AS FOLLOWS: <br />That the hearing before the Board was held a~ter <br />proper notice; <br />That the staff recommendation was approval o <br />Conditional Use Permit subject to the following conditi ns: <br />1. Reclamation of the site should include: soil repla ement, <br />sculpting of slopes where possible, and seeding as ach 2 <br />acre portion of excavation is completed; <br />2. A 75 foot buffer should be retained between major r ck <br />outcroppings at upper elevations on parcels A and B <br />3. A 25 foot strip abutting Highway 191 should be pres rued with <br />existing vegetation on both parcels; <br />4. No excavation work should occur on cliff faces; <br />5. There will be an annual review of permit; <br />6. No excavation will occur on weekends; <br />7. No activity will occur off site; <br />8. Should activity discontinue for two consecutive yea s the <br />permit will automatically be reverted; <br />That the Mesa County Planning Commission roc mmended <br />approval subject to the following conditions: <br />1. Should activity discontinue for two consecutive yea s the <br />permit will automatically be reverted; <br />That the Conditional Use Permit met with rel want Mesa <br />County land use Policies because the proposal will meet with <br />rural fire, water, sewer and access standards; <br />That the Conditional Use Permit is in accord nce with <br />the health, safety and welfare of the residents of Mesa County. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD 0 <br />COMMISSIONERS IN TEIE COUNTY OF MESA, STATE OF COLORADO, <br />Conditional Use Permit for granite mining and crushing <br />and amethyst mining is approved subject to the followin <br />conditions: <br />COUNTY <br />that the <br />Aerations <br />_._..,~R......... <br />
