By decision of the Colorado State Office, <br />the lessee, Grand Valley Coal Company, was granted a suspension of operations <br />and production pursuant to section 39 of the Mineral Leasing Act of 1920, as <br />amended, for a period of five years effective June 30, 1997. Effective <br />January 1, 2000, record title assignments were approved for the above- <br />referenced leases to Lodestar Energy, Inc. The suspension of operations and <br />production terminated on February 23, 2000. <br />The leases would normally have been readjusted on May 1, 1998, but because of <br />the section 39 suspension, the term of the leases was extended by the <br />suspension period of two years and 238 days and the leases would next became <br />subject to readjustment of their terms and conditions on December 25, 2000. <br />Notice of intent to readjust the coal leases dated August 2, 2000, was sent to <br />Grand Valley Coal Company by decision titled Suspension of Operations and <br />Production Terminated, New Dates Established for Readjustment, etc. No <br />decision containing the readjusted terms and conditions was sent before the <br />new readjustment date of December 25, 2000, as the authorized officer <br />prescribed in the decision. Therefore, as provided by the regulations at <br />3451.1(c)(2), we are hereby waiving the right to readjust the leases for the <br />readjustment period in question. As a result, the leases will continue with <br />the same terms and conditions as readjusted effective May 1, 1988.
