Based on the fact that this is an ongoing cooperative
project with Twentymile Coal Co., we do not feel that an NOI issued to the Bureau would be
appropriate for these activities. Information provided by the Bureau indicates that proposed
activities would have no impact on the surface. However, it is the responsibility of the pemrittee
to ensure that the surface, in particular, the topsoil resource, is adequately protected within the
permit boundary. From the standpoint of liability, this decision would be consistent with the
current policy regarding ranching activities at reclaimed coal sites.
Pond M Permanent Demonstration. Mine l , Mine 2 and Eckman Park
On April 14, 1994, the Division received a letter from Cross Mountain Ranch concerning their
desire to retain Pond M on the Mine 2 area as a permanent impoundment. Although this letter
is appropriate for these types of actions, the pond should be demonstrated as meeting the
requirements of Rule 4.05.9. Permanent Impoundments and processed with the Division as a
Technical Revision to [he approved permit. If the ditch leading to this pond is to remain, it
should also be included in this revision.
If you have questions or comments on the above issues, please call me.
Sincerely,
Kent A.
