Lamm <br />Governor <br />May 6, 1986 <br />Mr. Hank Davis <br />Peabody Coal Company <br />10375 East Harvard Avenue, Suite 400 <br />Denver, Colorado 80231 <br />RE: Geophysical Prospecting on Reclaimed Lands <br />at Seneca II (C-80-005) <br />Dear Mr. Davis: <br />This letter is to clarify the Division's position regarding geophysical <br />prospecting activities on reclaimed lands at the Seneca II mine site. <br />It is the Di vi son's understanding that the company conducting the geophysical <br />exploration work at the Seneca II mine, CGG Inc., is responsible for the <br />reclamation of all disturbances at the mine site which are a result of their <br />activities. This reclamation, which may include but not be limited to grading <br />and re vegetation, will be completed to the satisfaction of Peabody Coal <br />Company. <br />Furthermore, the Division will request that the Colorado Board of Land <br />Commissioners hold the CGG bond until such time as the Di vi son determines that <br />the reclamation of the site is complete and that the vegetation which has been <br />reestablished by CGG meets all aspects of the success criteria pertinent to <br />the Seneca II mine site. <br />This letter does not implicitly or otherwise release Peabody Coal Company from <br />reclamation liability at the Seneca II mine site. It is the Division's <br />position that Peabody Coal Company is responsible, from a reclamation <br />standpoint, for all disturbances within the approved permit area at the Seneca <br />II mine site. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
