Long <br />Divivon Director <br />On November 9, 1994, the Division received a letter from Mr. Jim Tatum regarding a variety of <br />concerns with the mining operation at the Golden Eagle and New Elk Mines. In this letter, the <br />Division was specifically requested to investigate a white foamy substance being dumped into <br />pond 4 at the New Elk Mine. <br />Division personnel were already in the field at the time we received this letter. As a part of the . <br />Division's normal inspection of the New Elk Mine, pond 4 was investigated. Present at the same <br />time was David Knope of the Water Quality Control Division of the Colorado Department of <br />Public Health and the Environment. At the time of the November 9, 1994 inspection, afluid-like <br />mud was found in pond 4. According to Basin Resources, this mud is used by Basin in the <br />drilling of water monitoring wells, exploration wells, and mine degasification boreholes. Use of <br />a drilling mud has'been approved for this purpose by the Division. <br />On November 10, 1994, this Division inspected all of the ponds at New Elk and Golden Eagle. <br />Only pond 4 at the New Elk Mine had drilling mud in it. <br />Because of the limited time remaining for that field inspection, and because research of the <br />permit was needed in this situation, it was decided not to take any enforcement action in the <br />field. However, upon conducting the research of the permit in the office, the Division has <br />decided to issue Notice of Violation No. C-94-034, for failure to properly dispose of this drilling <br />mud into an approved disposal area as required in the Golden Eagle permit. Enclosed is a copy <br />of NOV C-94-034. <br />STATE OF COLORADO <br />Rule 5.02.5(3) requires that when an inspection will result from a citizen's complaint, the citizen <br />will be allowed to be present during that inspection. Because a Division representative was <br />already at the mine site on the same day that Mr. Tatum's request for an inspection was received <br />
