Prooosed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve with <br />Conditions and Stipulations an application for renewal of a mining and <br />reclamation permit allowing reclamation only. <br />The application was submitted by tdew Castle Energy Corporation for the Coal <br />Ridge No. 1 Mine. This decision is based on a finding that the reclamation <br />will comply with all requirements of the Colorado State Program as found in <br />the Colorado Surface Coal Mining Reclamation Act, CRS 34-33-101 et seq., and <br />the Regulations promulgated pursuant to the Act. If no request ~r a formal <br />hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. The <br />permit application, all supporting documentation and any stipulations or <br />conditions will became a binding part of the permit. <br />r~;r.._ <br />The Division has been able to make the necessary findings for the proposed <br />_ reclamation operation which includes activities related to runoff and erosion <br />_ * control at the mine and activities associated with hydrologic monitoring. The <br />permit which issues as a result of this document will authorize only these <br />activit5~es within the permit area. The extraction of coal is expressly <br />forbidden by this decision. Additionally, the Division is requiring that the <br />permit be issued with the following Conditions and Stipulations: <br />Condition No. 1 <br />UPON DIVISION APPROVAL OF THE RENEWAL APPLICATION, THE APPLICANT SHALL <br />COMMENCE IMPLEMENTATION OF THE RECLAMATION PLAN AND COMPLETE ALL <br />BACKFILLING, GRADING, SEEDING, AND MULCHING OPERATIONS AS REQUIRED WITHIN <br />ONE (1) CALENDAR YEAR OF PERMIT ISSUE. <br />Stipulation No. 3 (as modified by Technical Revision 04) <br />THE DIVISION REQUIRES THAT COAL RIDGE N0. 1 MINE SUBMIT AN ANNUAL REPORT <br />BY JANUARY 15 OF EACH YEAR INCORPORATING THE FOLLOWING: <br />BEDROCK WELLS AND ALLUVIAL/COLLUVIAL WELLS <br />OW-3L, OW-12 <br />OW-4L, OW-l3 <br />OW-7, OW-14 <br />OW-8 <br />THESE WELLS ARE TO BE SAMPLED ON A BIANNUAL BASIS (TWICE A YEAR) AND THE <br />SAMPLES ANALYZED FOR THE FOLLOWING PARAMETERS: <br />Ca C03 <br />Mg SOq <br />Na N03 <br />K Fe <br />HC03 Cl <br />SAR Conductivity (lab) <br />TDS pH (lab) <br /> -2- <br />
