La:hhead <br />Executive Dvector <br />Michael B. I ong <br />Dnasion Direuor <br />The Division has reviewed your Topsoil Substitute Suitability Report prepared by Cedar <br />Creek Associates, Inc. The report was thorough and concise. Based upon the data <br />presented in the report and upon your statement that all salvageable topsoil from the topsoil <br />stockpiles has been utilized, the Division approves your request to seed all of the backfilled <br />slopes and the capped refuse area. The report indicates that the likelihood of successful <br />revegetation on the backfilled slope is substantial. <br />The Division's approval to seed the capped refuse area and the backfilled slopes without the <br />benefit of additional topsoil redistribution in no way diminishes the revegetation success <br />criteria for any of the disturbed areas. Furthermore, as per recommendation number 2 of <br />your report, if the Division determines that the initial seeding has failed, the Division may <br />require EFMC to procure additional topsoil material in sufficient quantities to satisfy the <br />permit requirement of topsoil replacement to a depth of 4.5 inches. Pursuant to Rule <br />4.15.7(5), topsoil replacement resulting from failure of the initial seeding would re-initiate <br />the period of extended liability under the performance bond requirements of 3.02.3. <br />The Division is tentatively approving a topsoil substitute pending our evaluation of the <br />revegetation success following seeding. Since this tentative approval of a topsoil substitute <br />is a variance from permit conditions, a Technical Revision will be required. The TR <br />application should include a copy of the Topsoil Substitute Suitability Report with EFMC <br />responses to the recommendation`s made in the report and the fact that this approval is <br />tentative, pending Division evaluati n to occur following two years from seeding. <br />~. <br />~ ~ ~u(~~ t1~~8/q~ <br /> <br />
