Non Exempt Consent Form <br />RN-GOAL-MINES-8 <br />CONSENT FOR RIGHT OF ENTRY FOR RECLAMATION ACTIVITIES <br />The State of Colorado, Department of Natural Resources, Division of <br />Minerals and Geology, and Energy Fuels Coal Inc. hereby represents <br />that the undersigned is the "Lessee" of the following real property <br />located in the County of Fremont and the State of Colorado: <br />NW1/4 NE1/4 of Section 30, 1205, R69W <br />As such, the undersigned hereby acknowledges to the agents, <br />employees, and contractors of the Divsion of Minerals and Geology, <br />Department of Natural Resources, State of Colorado, entrance upon <br />such lands to restore, reclaim, abate, control or prevent the <br />adverse effects of past mining practices and to do all things <br />necessary or expedient to protect the public health, safety or <br />general welfare. Such activities are in the public interest. <br />Consent is given to enter upon the above described property for the <br />length of time necessary to complete the reclamation activity <br />described on the attached pages of the G.E.C. Coal Revocation <br />Project, subject to the undersigned's continued ownership and use <br />of the property. <br />During the period of construction in Magpie Creek, the Division of <br />Minerals and Geology will assume responsibility for the condition <br />and maintenance of the drainage area affected as these factors <br />pertain to the Colorado Coal Regulations. The Division will <br />restore the affected area of Magpie Creek Diversion to the pre- <br />construction condition, as specified in the Southfield permit. <br />Upon completion of the West Pit Diversion, the Division will meet <br />with Energy Fuels in the field for the purpose of agreeing that the <br />affected area of Magpie Creek Diversion meets the specifications <br />set forth in the permit. Thereafter, the Division will return <br />responsibility of the affected area of Magpie Creek Diversion to <br />Energy Fuels. <br />Energy Fuels Coal Inc.
