The stockpile has shown no inr <br />instability and shows a good cover of vegetation. The Operator is seeking approval to all <br />its current configuration to remain as a permanent feature in the reclaimed quarry. Given <br />was constructed as a temporary feature, it exhibits steep side slopes and there is not likel} <br />on the degree of compaction applied during construction or the nature or consistency of t <br />contained within the stockpile. It is also unlikely that the stockpile was keyed in or other <br />prepared foundation. Since a good stand of vegetation has developed, the Division can si <br />stockpile in its present configuration does not conflict with the selected post mining land <br />habitat. It remains for the Operator to demonstrate that the stockpile will be stable in the <br />accordance with the performance standards of Rule 3.1 of the Construction Materials Rul <br />of the Colorado Mined Land Reclamation Board. This memorandum is intended to provi <br />with guidance on the type of information the Division will require for the stockpile stabil <br />The Mined Land Reclamation Board generally discourages the construction of steep <br />reclaimed landscapes. Reference the following citations from the regulations. <br />:• Rule 3.1.5(1) -Grading shall be carried on so as to create a final topography appropi <br />land use selected in the Reclamation Plan. <br />•:• Rule 3.1.5(2) -When backfilling is part of the plan, the Operator shall replace overb <br />materials in the mined area and shall ensure adequate compaction for stability... <br />:• Rule 3.1.5(3) -All grading shall be done in a manner to control erosion and siltation <br />lands, to protect areas outside the affected land from slides and other damage. <br />•:• Rule 3.1.5(7) -Maximum slopes and slope combinations shall be compatible with tl <br />surrounding conditions and selected land use. <br />:• Rule 6.3.4(1)(6) - If the Application proposes slopes steeper than 3:1, the Operator/~ <br />include ajustification that supports steeper slopes for the proposed post-mining land <br />demonstrates compliance with the applicable performance standards of Section 3.1. <br />However, if the stockpile at the Surface Rock Pit were stable, it would be counterprodi <br />it be regraded or removed.
