Lamm <br />Governor <br />DATE: May 29, 1986 <br />T0: Mike Long, Jeff Deckler <br />FROM: Dale Plume~~ <br />RE: COAL SPILL CAUSED BY APPARENT UNION SABOTAGE AND THE NEW ELK AND GOLDEN <br />EAGLE MINES <br />Dave Stout of Wyoming Fuels Corporation (WFC) called me on May 27, 1986, to <br />inform me that a truck moving either coal refuse or coal along the road <br />between the Golden Eagle and New Elk Mines had been tampered with. This <br />tampering resulted in a spill about 1 mile long along the road (Highway 12 and <br />160?) by dribbling out the coal. The tampering had apparently been caused by <br />Union Saboteurs; and, WFC had evidence of the suspected responsible parties <br />and had them arrested. <br />I advised him that as far as I knew, we could not write a Notice of Violation <br />because this was caused by a "Third Party" intervention. I also informed him <br />that he should contact the State Attorney General's Office about a possible <br />injunction or restraining order against the Union, to prevent this from <br />occurring again. <br />I talked to Dave Shelton about this and he advised me to tell Mr. Stout to <br />contact Linda White of the Attorney General's Office. He suggested it would <br />be in the Mined Land Reclamation Division's best interest not to get involved <br />in this matter.
