A permittee may request reduction of the required <br />performance bond amount upon submission of evidence to the <br />Division proving to the Division that the permittee's method <br />of operation or other circumstances will reduce the maximum <br />estimated cost to the Division to complete the reclamation <br />responsibilities and therefore warrant a reduction of the bond <br />amount. Such a request shall be considered as a request for <br />partial bond release under 3.03." <br />The operator has provided to the Division drill hole <br />abandonment reports and maps that identify the reclamation <br />work completed on the drill sites. Under the 1985 drilling <br />project, only six holes were drilled out of the 57 proposed. <br />Field investigation by the Division verified that backfilling <br />of mud pits and regrading of drill sites have been completed <br />for all holes drilled under the 1985 and 1988 drilling <br />projects. Field investigation also verified that the <br />remaining 51 holes were never drilled under the two projects. <br />All of the drill pads and mud pits have been seeded with the <br />approved seed mix. The Division finds that the drill holes <br />have been abandoned in accordance with the requirements of <br />Rule 4.07.3. The Division also finds that all holes sustain <br />successful establishment of vegetation in accordance with rule <br />3.03.1(2)(b) with the exceptions noted below. <br />Hole SF-85-03: Requires interseeding with the approved seed <br />mix. <br />Road SF-85-O5: Requires interseeding with the approved seed <br />mix. <br />Hole SF-88-14: Requires burial of the concrete plug in <br />accordance with rule 4.07.3(1) and <br />interseeding with the approved seed mix. <br />As the result of the inspection and evaluation of the reclamation <br />in accordance with Rule 4.07.3(2), the Division finds that <br />reclamation has progressed minimizing impacts to the hydrological <br />balance. <br />
