I received the letter on November 17, 1994 <br />and would like to take this opportunity to respond. <br />I can see from your letter that you have worked diligently to bring issues and conditions which <br />you believe to be important to the attention of local and state officials charged with protecting the <br />environment and the health and welfare of the public. Participation of interested citizens is an <br />important part of the taw which we are responsible for administering. It is also apparent from <br />your letter that you are frustrated with what you perceive to be inaction or slow responses on the <br />part of the government officials you have contacted. <br />To assist you, we have contacted Ms. Millie Turner at the Air Pollution Control Division to <br />reiterate your concerns to her and that you are awaiting her response. Your concerns related to <br />water quality and air quality are best addressed directly to the Colorado Department of Health <br />and Environment. We are interested in assisting you in your dealings with these other state <br />agencies, but our ability to do much more than refer your concerns and make phone calls to <br />ensure that they are aware of your concerns is limited. I therefore suggest that you focus your <br />future correspondence related to air and water quality to the people who are able to respond to <br />you directly. <br />You have numerous times pointed out that the Division made an error in their initial determina- <br />tion of distance separating your home and the northern extent of mining in the first north main. I <br />apologize for the error. This en•or occurred in July 1993 and was identified and corrected in our <br />correspondence to Las Animas County dated August 12, 1993. A copy of that letter was sent to <br />your offices a[ that time. The information provided to the Office of Surface Mining in December <br />1993 reflected the cornected distance. <br />
