During our conversation [informed you that [he Division of Minerals and <br />Geology has a concern about whether Comstock Mining has the required legal right to enter and <br />mine she permitted area. From the Division's files, it appears that Comstock's legal right to enter <br />was based on a ]ease from landowners, Harry and Astrid Covey. However, Mr. Covey appears <br />to have terminated the lease several years ago. <br />In our February [ lth conversation, you said that you aze trying to negotiate a new <br />1 agreement with Mr. Covey and would contact him to facilitate such an agreement. On February <br />\~,// 28 anal March 7, I called you and left voicemails asking you to inform me of the status of any <br />~ agree.ment between Comstock and the Coveys. You have not returned my phone calls. <br />Please contact me immediately at (303) 866-5127 and inform me about Comstock's <br />\ ability to enter and mine the permitted area, including any agreement you have reached with the <br />~ Coveys. If I have not heazd from you by March 31, 2000, the Division will issue a notice of <br />~ violation stating that it has reason to believe Comstock is not in compliance with applicable <br />( statutory, regulatory and permit conditions, and this matter will be set for heazing before the <br />v Mined Land Reclamation Board for possible revocation of Comstock's permit and forfeiture of <br />its bond. <br />
