<br />PROPOSED DECISION - Canadian Strip/Phase II Bond Release <br />October 1, 1990 <br />Page 7 <br />The Division is also retaining bond to cover the following projects which <br />may or may not have to be performed: <br />1) total re vegetation failure; <br />2) finish grading along the settlement cracks. <br />IV. PROPOSED DECISION <br />The Division proposes to grant Phase II Bond Release for reclamation <br />success at the Canadian Strip Mine. Specifically, the Division <br />acknowledges that topsoil has been replaced according to the reclamation <br />plan and has been stabilized as evidenced by the fact that erosion from <br />the entire reclaimed 75.6 acres is less than that which occurred at the <br />site Drior to mining. In addition, the Divis i• ds that vegetative <br />cover success standards have been met in the 22.9 ages reclaimed between <br />1979 and 1981 (Areas I, II and III delineated n-Figure 2A of the Bond <br />Release submittal). Vegetation cover success standards of ninety Dercent <br />of the reference area cove ,i h ninety percent statistical accuracy have <br />not been achieved on the 2.7 cres reclaimed in 1987. ATthough the <br />vegetation cover is suff t to have stabilized the soil. This request <br />was made by Wyoming Fuel Company in accordance with Rule 3.03 of the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining <br />and Colorado Surface Coal Mining Act, C.R.S. 34-33-125, et. seq. <br />The Canadian Strip Mine is located 4.5 miles east of Walden, Colorado. <br />The mine is located in portions of Sections 2, 10 and 11, T8N, R78W, 6th <br />P.M. All lands listed above may be located on the USGS 7.5 minute <br />quadrangle entitled Johnny Moore Mountain. <br />This proposed decision is based on a site inspection conducted September <br />5, 1990, review of the monitoring and permit files and information <br />submitted by the operator in support of the Phase II Bond Release. The <br />Division determined that the cost of completing reclamation activities at <br />the site was less than the fifteen percent remaining after an eighty-five <br />percent release as allowed under a Phase TI Bond Release and, thus, <br />proposes to release $186,612. <br />The Division proposes to release eighty-five percent of the $746,450 <br />original bond for the maximum disturbance which occurred at the site. <br />Phase I Bond Release for sixty percent of the $746,450 was granted in <br />December of 1988, leaving a bond of $298,580.
