<br /> <br />not begun, therefore, the operator has proposed to submit designs for ponds <br />within the Moffat Area no later than six months prior to initiation of <br />construction in the Moffat Area. The following stipulations remain in effect <br />from the previous permit term: <br />Stipulation No. 1: <br />THE PERMITTEE MUST SUBMIT TO MLRD THE DESIGNS FOR THE MOFFAT AREA SEDIMENT <br />PONDS AT LEAST SIX MONTHS PRIOR TO CONSTRUCTION, AND RECEIVE APPROVAL FOR THE <br />PROPOSED DESIGN BEFORE COMMENCING CONSTRUCTION OF THE PONDS OR MINING IN THE <br />MOFFAT AREA. THESE DESIGNS WILL REFLECT CURRENT REGULATORY DESIGN CRITERIA <br />AND APPROVAL WILL 8E CONTINGENT ON INFORMATION DEMONSTRATING THA7 THE PONDS <br />OUTFLOW WILL MEET EFFLUENT LIMITATIONS. <br />Stipulation No. lc: <br />THE APPLICANT SHALL SUBMIT DESIGN DATA FOR EACH OF THE MOFFAT AREA <br />SEDIMENTATION POND INFLOW DITCHES. THIS INFORMATION SHALL INCLUDE EVIDENCE <br />THAT DITCH SLOPES WILL PROVIDE POSITIVE DRAINAGE TO THE PONDS WITH ACCEPTABLE <br />VELOCITIES. THE INFORMATION SHOULD ALSO DEMONSTRATE THAT BERMS TO BE <br />CONSTRUCTED WILL NOT SIGNIFICANTLY IMPOUND WATER. <br />The Division was concerned about the stability of the proposed Moffat Area <br />sediment ponds. Pittsburg and Midway prepared and submitted to the Division <br />geotechnical and stability analyses for these proposed ponds. The submitted <br />information satisfactorily addressed the Division's concerns. <br />The Division was concerned that the flow from Diversion Ditch 1 in the Moffat <br />Area would outlet into Pond 8. Also, the Division was concerned that the <br />outlet of Diversion Ditch 1 would erode the receiving draw, therefore, erosion <br />control was necessary. Pittsburg and Midway has submitted construction <br />information demonstrating that flow from Diversion Ditch 1 will not outlet <br />into Pond 8 and that additional erosion control measures are not necessary to <br />protect the receiving draw from erosion. The submitted information <br />satisfactorily addressed the Division's concerns. <br />Monitoring <br />A surface water monitoring program has been defined and is being conducted in <br />a continuing manner. Aspects of the program include NPDES monitoring of pond <br />effluent, stream sampling, spring and seep surveys, and quarterly pond <br />inspections. Results and interpretation of all surface water data, along with <br />ground water monitoring, are discussed in annual hydrologic reports, submitted <br />to the Division. <br />-15- <br />January 13, 1988 <br />
