<br />"Summary" <br />The Division issued the Proposed Decision and Findings of Compliance to <br />approve P & M's permit renewal application, subject to eight (8) stipulations, <br />on April 16, 1987. This proposed decision was published, pursuant to the <br />requirements of Rule 2.07.4(2)(d), on April 23 and 30, 1987. <br />On May 22, 1987, which was within the thirty (30) day public comment period, <br />P & M objected in writing to the proposed decision and requested a formal <br />hearing before the Board in accordance with C.R.S. 34-32-119(4). The Division <br />and P & M met on June 9, 1987 to address the objections to the proposed <br />decision. P & M and the Division agreed to attempt to negotiate a settlement <br />to the objections to the proposed decision. <br />After negotiating over a period of time, a Settlement Agreement was reached <br />between P & M and the Division on November 16, 1987. This Settlement <br />Agreement was presented to the Board on November 19, 1987 and was approved by <br />the Board by an unanimous vote. The settlement agreement reduced the number <br />of stipulations to four (4), committed P 8 M to a number of activities, and <br />modified the amount of the performance bond required from E7 ,580,933.00 to <br />E7,]21,196.00. <br />A bond in the required amount was submitted by P & M on December 18, 1987 and <br />was accepted by the Division on January 7, 1988. Therefore, the performance <br />bond stipulation, Stipulation No. 5, was adequately resolved reducing the <br />final number of stipulations to three {3 ). <br />Based upon this Settlement Agreement, it is necessary to modify various <br />sections of the April 16, 1987 Proposed Decision package. Enclosed are pages <br />intended to replace in total pages from the April 16, 1987 issued Findings of <br />Compliance. The same numbering sequence as originally used is used here and <br />the replacement pages are denoted by a January 13, 1988 date in the lower <br />right hand portion of the page. The pages that are replaced are pages 15, 38, <br />39, 40, 41, 42 and 45. <br />-4- <br />
