for a term of 5 years. This Mid-Term Review covers the time period May 4, <br />1988 to present. The main focus of activities during this time period have <br />been devoted to reclamation as mining activity ceased in 1987. <br />Backfilling and final grade was achieved on 33 acres known as the "East Dump" <br />in 1983 and seeding was completed the last week of September 1984. <br />Backfilling and final grade on 110 acres at the mine site was completed in <br />early October of 1988 and seeding took place the following week. Grading and <br />seeding on 4.5 acres at the Northgate loadout was also completed in October of <br />1988. Terrace benches were constructed to controi erosion prior to <br />revegetation establishment and are the only form of sediment control left on <br />the site as ali sediment ponds have been removed and reclaimed. Inspections <br />to date have shown this method to be successful in controlling sediment <br />leaving the site. Minor rilling has been stabilized with use of hay bales and <br />monitoring will continue through monthly inspection and the annual rill and <br />gully inspection. Vegetation success at the site is also monitored by the <br />operator on an annual basis and appears to be progressing well. Surface water <br />is no longer monitored at the site as there are no "point source" discharge <br />locations. Ground water monitoring continues at the two remaining wells <br />iocated in the Mann Draw alluvium. Water level and quality are checked once <br />in the spring and once in the fall and results are submitted annually in <br />conjunction with the other required annual reports. Results to- date of the <br />hydrologic monitoring show no undesirable affects from mining. <br />No stipulations or variances are associated with the current permit of Walden <br />Coal Company (C-81-021). <br />The following enforcement actions took place during the current permit term <br />NOV C-89-010 was written on April 5, 1989 for failure to perform water quality <br />monitoring and failure to maintain water quality monitoring devices at the <br />site. Abatement of this violation took place on 5/24/89 and final civil <br />penalty was assessed and received of $500.00 on 6!20189. <br />TDN X-91-02-244-008-TVl was issued by the OSM for failure to maintain a <br />minimum of 407. of the approved bond amount after a Phase I bond release but <br />prior to obtaining a Phase II bond release.
