Banta. <br />Division Director <br />August 9, 1991 <br />Mr. Scott Patten <br />Walden Coal Company <br />Box 229 <br />Boulder, CO 80306 <br />Re: Bourg Midterm Permit Review, Permit No. C-81-021 <br />Dear Mr. Patten: <br />Enclosed is the Division's Midterm Review and Decision to require revisions to <br />the Sourg Mine, Permit No. C-81-021. <br />Rule 2.08.3 of the Regulations promulgated pursuant to the Colorado Surface <br />Coal Mining Reclamation Act (C.R.S. 34-33-101 et sew.) requires the Mined Land <br />Reclamation Division to conduct a Midterm Permit Review. A review of <br />outstanding permits is to be conducted and, for good cause shown, reasonable <br />revisions or modifications of the permit provisions during the term of each <br />such permit may be required. Such revisions or modifications shall be based <br />upon written findings and shall be subject to the notice and hearings <br />requirements of the Act. Additionally, Rule 3.02.2(4) requires that the bond <br />be re-evaluated. <br />The Midterm Review consisted of reviewing the permit application, stipulation <br />responses, revisions, and any supplemental information, as well as information <br />from field inspections and past inspection reports. The main purpose of the <br />review was to identify any areas of the permit application that will need to <br />be revised or modified to ensure compliance and reflect the current status of <br />the mine. <br />The Division requests that Walden Coal Company submit response to this review <br />by September 15, 1991.
