LIAR-Ofi-2002 1D:54 FROL1-DOL NATURAL RESOURCES <br />3636663558 T-515 P.003/664 F-617 <br />NOTICE OF TERMINATION OF RECLAMATION OBLIGATION <br />Mid-Continent Resources, Inc. (MCR) held a mining and reclamation permit (No. C-8I- <br />017) to operate the Coal Basin Mine located west ofRedstone in Piikin County. The <br />Coal Basin Mine consisted of five sepazate ttnflergrotutd mines, a rock tunnel entry, a <br />preparation plant, two coal waste piles, one development rock waste pile, an extensive <br />road system, and numerous anciAary facilities. <br />MCR filed a petition in bankruptcy in 1992. The Colorado Mined Land Reclamation <br />Board revoked MCR's operating permit and forfeited MCR's reclamation bond in 1993. <br />The Division of Minerals and Geology (Division) acquired funds to conduct reclamation <br />of the Coal Basin Mine from MCR's bankruptcy proceeding and a subsequent District <br />Court action. The District Court action (Boazd of Countv Cotnmissioaers v. Mid- <br />1 CV 131-1), <br />consistent with <br />the statutory reclamation requirements of the Colorado Stuface Coal Mining Reclamation <br />Act, specified the reclamation activities that the Division would undertake on property <br />owned by MidCon Realty, LLC. The specific description of the MidCon Realty property <br />which was attached to the Settlement Agreement is attached to this Notice. <br />The Division has completed she reclamation tasks described in the Settlement Agreement. <br />The Division hereby gives notice, in accordance with the District Court action, that no <br />funher reclamation obligation due to past mining operations exists on the MidCon Realty <br />property described in the attachment to this Notice. No additional reclamation related <br />tasks will be undertaken by the Division on that property. <br />ichael B.
