Landau <br /> )amen S.Lochhead <br /> Cotter Corporation Ezeculive Director <br /> 12596 West Bayaud Ave. Michael a Long <br /> Division Director <br /> Suite 350 <br /> Lakewood, CO 80228 <br /> RE: Ike No. 1 Mine, Permit No. M-77-451, Notice of Determination as Designated <br /> Mining Operation <br /> Dear Mr. Landau: <br /> In response to your letter dated December 22, 1994 it is the Division's position that the basis <br /> for the determination of the Ike No. I as a designated mining operation is the fact that <br /> toxic-forming materials are or will be exposed or disturbed as a result of mining operations. <br /> Pursuant to the approved permit, uranium and vanadium will be mined from the Ike No. 1 <br /> adit. The ore will be stockpiled in one area and the waste rock stockpiled in another area. <br /> Uranium, vanadium, and their byproducts, are toxic materials at certain concentrations. <br /> There is a reasonable potential for these toxic materials to exit the permit area and/or <br /> adversely affect human health, property, or the environment. If you have evidence to the <br /> contrary please send it to the Division. <br /> Pursuant to Rule 7.2.4(1)(a) the Office shall meet with the operator to discuss the pending <br /> designation.
