Trinidad Colorado Operation <br />Dear Mr. Savage: <br />In pursuant to our telephone conservation of last Wednesday, <br />I wish to inform the Mined Land Reclamation Board that no one <br />had or has my permission to enter upon my land for any purpose <br />other than Trinidad Basin Mining Company or its employees and <br />their permission to enter thereon is limited to the completion <br />of reclamation in accordance with their reclamation plan. <br />Furtheremore, there is presently pending in the District Court <br />of Las Animas County, a suit filed by Victor America Fuel Co. <br />Vs. Alvin E. Wiggins, Et Al for judicial construction of the <br />"reservation clause" contained in a warranty deed to Alvin & <br />Lillian Wiggins in 1967. All pleadings and answers are of record <br />in said lawsuit and contains all issues in dispute. <br />As owner of the surface lands, request is hereby made that the <br />following ponds be left in their present form on my portion of <br />the ranch for use as stock ponds, Sec. 22, Pond 17; Sec. 15, <br />Ponds•.:,`2 and #1. <br />If any further information is desired, please feel free to <br />contact me or my attorney, Mr. Gerold Sjaastad at his office in <br />Colorado Springs.
