Banes. <br />Division Director <br />During the last complete inspection, Mr. Jim Stevens requested that a copy of <br />the insurance policy required by Rule 2.03.9 be retained with the records <br />available for public scrutiny. The staff took this opportunity to review the <br />policy and requests that the policy be clarified and modified, <br />a. Please revised the "Named Insured" to specify each mine covered by <br />the policy per Rule 2.03.9(11. <br />b. Rule 2.03.9(11 requires that minimum insurance coverage for bodily <br />injury shall be E300,000 for each occurrence and 5500,000 <br />aggregate; and minimum insurance coverage for property damage shall <br />be 5300,000 for each occurrence and and 5500,000 aggregate. We <br />need to be assured that if each named insured company suffered a <br />loss, that the minimum liability limits would apply, OSM has <br />asserted that some coal companies within the state are underbonded, <br />as OSM has taken the policy limits and divided by the number of <br />listed mine sites, Please discuss this with your insurer and <br />modify the upcoming premium declaration to clarify this situation. <br />Please respond to these questions withi <br />your insurance policy before it expires <br />questions about this, feel free to call, <br />n sixty days to permit modification of <br />on July 21, 1991.
