-zl- <br />The Division requested that the applicant modify the sampling plan origina!Ily <br />submitted to meet the objectives of Rule 4.24.5 of the Colorado Permanent <br />Regulatory Program. Colowyo subsequently committed to installing a shallow <br />ground water well downgradient of the Gossard Loadout to monitor ground <br />water levels and quality. The well will be monitorc~i quarterly and results <br />will be submitted to the Division annually. The analyses will include all <br />of the parameters listed in Section Vr-Hydrologic Balance - Ground Water <br />of this document. <br />ELKHORN CREEK <br />The lower reaches of Elkhorn Creek contain unconsolidated streamlaid <br />deposits which are sufficient to constitute an AVF. The applicant has not <br />presented sufficient information to allow the Division to assess the <br />irrigation properties of the potential RVF. In a joint field visit <br />between Colowyo and the Division, it was mutually decided that the <br />vegetation growing in the lower reaches of Elkhorn Creek is probably <br />subirrigated. Therefore, unless the applicant presents sufficient evidence <br />to the contrary, the lower reaches of Elkhorn Creek (as shown on Map 10) <br />constitute an AVF. Map 17 shows that the Land use in the AVF is pastureland. <br />Baste upon the information provides by the applicant and the Division's <br />investigation, the Division makes the following finding. <br />Pursuant to Rule 2. 06.8(5)(a)(iii), the Division finds that surface <br />coal.mining and reclamation would be conducted to preserve, throughout <br />the mining and rc~lamation process, the essential hydrologic functions <br />of the alluvial valley floor. <br />Because no disturbance is planned for the Elkhorn Creek drainage basin, <br />no impact on the essential hydrologic functions of the AVF is anticipated. <br />The Elkhorn drainage basin is hydrologically isolates from the mining <br />area. As a;result, no hydrologic monitoring is required on the Elkhorn <br />Creek AVF. <br />VIII. Probable Hydrologic Consequences and Cumulative Hydrologic Impact <br />Assessment - Rule 2.05.6(3) <br />In the Draft Findings document dated December 23, 1981, the Division noted <br />a number of concerns with regard to the probable hydrologic consequences <br />statement prepared by the applicant. Specifically, the Division asserted <br />that insufficient data and analyses were contained in the application to <br />prepare a complete and thorough cumulative hydrologic impact assessment. <br />In response to that document, Colowyo submitted a revised probable hydrologic <br />consequences statement on May 24, 1982. Sufficient site-specific hydrologic <br />data, analyses, and projections were includes in these responses to satisfy <br />the Division's concerns. <br />
