-11- <br />II. Land Use - Rules 2.04.3, 2.03.5 and 4.16 <br />Site description and land use information is provided on pages 2.04-1 through <br />2.04-7 of Volume I of the application. The specific objectives of the <br />reclamation plan and details of the post-mining management plan are described <br />on pages 2.05-58 through 2,05-6I of volume I. <br />The applicant plans to return the disturbed area to rangeland capable of <br />supporting the historic uses of livestock grazing and wildlife habitat. This <br />land use is consistent and compatible with adjacent land uses. The Bureau <br />of Land Management, the agency responsible for managing the federal Land on <br />the permit area, has reviewed the plan and stated by letter that the post- <br />miningland use of rangeland is acceptable... <br />Pursuant to Rule 2.07.6(2)(1), the post-mining land use of rangeland proposed <br />by Colowyo is hereby approved by the Division. Rangeland will meet the <br />requirements of Rule 4.16. <br />ZII. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br />On the basis of information submitted by Colowyo in Section 2.04.4 of Volume I <br />and Appendix 5 of Volume II of the application, and as a result of the Colorado <br />State Historical Preservation Office's determination, the Division finds, <br />pursuant to Rule 2.07.6(2)(e), that the proposed mining operation will not <br />adversely affect any publicly owned park or place Listed on the National Register <br />of Historic Places. <br />Although not required by the Colorado Surface Coal Mining Reclamation Act, <br />federal Laws and regulations require further consideration of "cultural or <br />historic resources eligible for listing on the National Register of Historic <br />Places." The OSM Technical Analysis for cultural resources is included as <br />Attachment 1 to the document. <br />The operation is in compliance with the requirements of this section. <br />1'V. Geology - Rules 2.04.5 and 2.04.6(1) <br />The geology sections of the permit application, Section 2.04.6 of Volume I <br />and Exhibit 6 of Volume II, have been reviewed by the Division for compliance. <br />In the Preliminary Adequacy Letter of April 20, 1981, the Division requested <br />a more specific geologic description, including detailed strati graphic sections <br />of the Williams Fork Formation. Colowyo provided this information, along with <br />the revised geology map (Map 7) in their Adequacy Review Responses - Volume <br />VIII of the application, In the same letter, the Division requested that <br />results of analyses of the interburden below the X coal seam be submitted and <br />stated that a number of required parameters had not been included in the <br />analyses. In addition, the Division noted that the overburden analyses had been <br />run on material obtained from a single bore hole. The Division questioned <br />whether the single bore hole provided sufficient data to assess the chemical <br />properties of the overburden and interburden to be affected. <br />
