the developer is already trying to change the mining plan from its original application and current <br />permit. The permit stipulates that the MLRB must be informed of any changes in the mining plan. <br />Our reason for addressing this letter directly to you, with copies to all ofthe MLRB members, <br />is to bring to your and the Boazd's attention the seriousness of this problem and to ask that you <br />provide the resources and guidance necessary for resolving this issue. In addition to any penalties <br />you may impose, we feel that a stop work order is appropriate until all the permits have been <br />obtained. <br />This division and the MLRB has a responsibility to protect the public from health and welfare <br />hazards. To start mining without: 1) establishing the amount of contaminants being emitted from <br />the operation, and 2) without providing enforceable controls for regulated pollutants, aze issues that <br />need to be addressed and con~ected. Until these issues are resolved, the emissions of hazardous <br />pollutants can only be controlled by ceasing operations at the mine site.
