Morrison, Physical Scientist, Mined Land Reclamation Division <br />FROM: Julie Kraus, Water Resources Engineer, Division of Water Resourc~,1,~ I V I~tf/j~ <br />SUBJECT: Western Fuees Utah,, Dado Mine, File No. C-81-018, PR 03 -00""""__ <br />As you may recall, on September 26, 1991, our office reviewed the above referenced mining <br />permit application. The September memorandum outlined some pending water rights issues we <br />saw with the underground coal mining operation and recommended denial of the project until <br />such water rights issues were resolved. Subsequent to submitting our evaluation and <br />recommendations, Mr. Murari Shrestha, Western Fuels-Utah, Inc., has provided correspondence <br />which clarifies that the current operation of the Deserado Mine is with existing valid water rights <br />decreed for industrial use. Moreover, Mr. Shrestha clarified that the Gross-Nichols water rights <br />will not be used by Western Fuels-Utah until such changes are approved by the Water Court. <br />Based on this information provided by the applicant, please accept this memorandum to the file, <br />withdrawing our previous objections to the mine permit revision application. <br />cc: Mr. Murari Shrestha, Western Fuels Utah, Inc. <br />Mr. Ed Blank, Division Engineer <br />~pV 13 199"~ <br />dined Land <br />geclart'ation `Ji~ris~' <br />
