The September memorandum outlined some pending water rights issues we <br />saw with the underground coal mining operation and recommended denial of the project until <br />such water rights issues were resolved. Subsequent to submitting our evaluation and <br />recommendations, Mr. Murari Shrestha, Western Fuels-Utah, Inc., has provided correspondence <br />which clarifies that the current operation of the Deserado Mine is with existing valid water rights <br />decreed for industrial use.
