Box 5482 <br />One Park Central <br />1515 Arapahoe Street <br />Denver, Colorado 80202 <br />RE: Notification of State Reclamation Work on Railroad Property <br />Dear Sir or 14adam: <br />The State of Colorado, Mine Land Reclamation Division will be undertaking <br />reclamation work at an underground coal mine site located on the Western Slope <br />of Colorado in Gunnison County. Specifically, the mine site is situated along <br />State Highway 133 approximately 3 miles east of the town of Somerset at the <br />end point of Rio Grande rail line. The name of the operation is the Hawk's <br />Nest Mine and a portion of the area to be reclaimed appears to be situated on <br />Rio Grande Railroad property, based on surface ownership information submitted <br />to the Division by the last operator of the mine, Western Slope Carbon, Inc. <br />The legal description of this area is the SE 1/4, SW 1/4 and SW 1/4, SE 1/4 of <br />Section 10, T13S, R90W. -- <br />The Division is writing this letter in order to notify Rio Grande Railroad of <br />the impending reclamation work and to obtain verification that the portion of <br />land shown in our files to be on Rio Grande property is at the present time <br />still owned by the railroad. I have enclosed a map of the area that outlines <br />Rio Grand Railroad property. This map also depicts the particular mine <br />features within the property that are planned to be reclaimed. <br />to working with the railroad prior to beginning any construction to ensure <br />that all concerns the railroad may have related to construction work on <br />Rio Grande property can be adequately worked out. <br />The reclamation work will involve removing all remaining coal material from <br />the coal stockpile area, removing the truck dump, conveyor and silos, <br />regrading the area to approximate original contours, and revegetating the area <br />with grasses and fortis. With the exception of the 2 concrete silos, work <br />areas are situated away from the tracks and construction activities will not <br />interfere with track usage. Removal of the 2 silos presents a construction <br />difficulty, however and we will need to have all silo removal construction <br />activities adequately coordinated in order to prevent interference with track <br />useage or damage to the tracks. The construction contract will specify that <br />any interference with track usage and/or any damage to the tracks be <br />prevented, however we will also include contract language covering immediate <br />repair of the tracks in the event that damage does occur.
